Terms of use

1. Scope of use

kayvee is a trademark of kessler.vogler gmbh, Schifflände 22, 8001 Zurich, Switzerland (hereinafter "kayvee") and offers a dynamic job and career portal for private users ("users"). These Terms of Use apply to all products and services offered by kayvee to job seekers (hereinafter also referred to as "Users").


2. Agreement to the terms of use

By using the kayvee services via kayvee, the user agrees to the following terms of use.

3.1. Registration of an account

Every user has the possibility to register free of charge via kayvee and to create an account. This requires information such as your name, a valid email address and a personal password. By sending the "Register" button, the user creates an account. With the creation of the account a contractual relationship is established between the user and kayvee.

3.2. Use of services with kayvee account

Registered users have access to the following free services:

a)      JobAbo: Users can save a job search via their kayvee account and receive matching job offers via email on an ongoing basis.

b)    Watchlist: Users can save and/or delete job offers and access the saved job offers.

c)     Function "Display original advertisement": With this function, users leave the kayvee website and access the website of third parties.

d)     "Upload CV" function: With the "Upload CV" function the user sends his CV and application data to kayvee and makes his data available. Users are solely responsible for the format and content of their CV and application data.

e)    "Chat" Function: With the "Chat" function kayvee offers a live chat. For this purpose, kayvee collects and uses the data collected during the live chat for consulting purposes. The user can cancel the live chat at any time by closing the window opened for the chat. The user alone decides which data will be disclosed during the live chat.


3.2.  Use of services without a kayvee account

Users without a kayvee account can use all services that are available on the kayvee website without registration. In particular, unregistered users can search for job offers and submit their CV and application data to kayvee. In addition, non-registered users have the possibility to use the chat function.

kayvee reserves the right to add new services and products at any time, to change them or to discontinue them in whole or in part.


4. Privacy Policy

kayvee attaches great importance to privacy and therefore only processes personal data in accordance with the applicable legal provisions. kayvee is a trademark of kessler.vogler gmbh ("kessler.vogler"). Therefore the privacy policy of kessler.vogler is applied. The corresponding data protection declaration and further information on the use of personal data can be found on the websites of kayvee and kessler.vogler (www.kesslervogler.ch).


5. Costs

The use of the products and services offered by kayvee under these Terms of Use is free of charge. In the case of paid products and/or services, kayvee will clearly inform the user before using them on the website.


6. Obligations of the user

All data provided must be complete, current and truthful. Should the user provide incomplete or incorrect information, kayvee has the right to terminate the contract of these terms of use and/or to block the kayvee account temporarily or permanently. The user may only use his kayvee account personally and is obliged to keep access data and passwords safe and not to pass them on to third parties. Should a third party gain access to a user's kayvee account, the respective user is obliged to inform kayvee immediately.


7. Intellectual property

All property and protective rights to the website of kayvee, in particular copyrights as well as rights to trademarks, designs and know-how remain with kayvee, respectively kessler.vogler. kayvee grants users a non-exclusive, non-transferable right to use the products and services offered on the website in accordance with these terms of use.


8. No guarantees

kayvee makes no warranties with respect to its website or the products and services offered by kayvee. In particular, kayvee does not warrant that for the uninterrupted or trouble-free availability of the products and services as well as the topicality, correctness, completeness or suitability of the content for a specific purpose. kayvee does not guarantee that submitted application documents will be received, read or answered or that a successful job placement will take place.


9. Liability

10. Contract duration and termination

These terms of use apply for the duration of the use of services by the user or for users with a kayvee account from the creation of the account for an indefinite period. Users with a kayvee account can terminate the contract between them and kayvee at any time a) by sending a letter to kayvee c/o kessler.vogler gmbh, Schifflände 22, 8001 Zürich or b) by sending an e-mail to info@kayvee.ch. In such a case, kayvee will delete the account and all data irrevocably and irrevocably if the data is not used to process the contractual relationship, to assert or enforce legal claims or if kayvee is legally obliged to store the data. kayvee reserves the right to anonymise the data instead of deleting it. 11. Change of the service offer

kayvee reserves the right to change or discontinue the products and services offered at any time, in whole or in part. The user does not have any claims against kayvee due to a change or discontinuation of products or services.


12. Change of these terms of use

kayvee shall inform the user of the change to these Terms of Use in text form at least six weeks before it takes effect. Users are entitled to object to the change at the latest two weeks before it becomes effective. If the user does not object or does not object in text form in due time, the user's consent to the change shall be deemed to have been given and the new provision shall come into effect for the user on the planned date. If the user objects in due time, kayvee shall have the choice to continue the contractual relationship with the user affected by the change under continuation of the old terms of use or to terminate it as of the date on which the planned change takes effect. kayvee shall draw the user's attention to kayvee's right of termination, the objection period to be observed by the user and the consequences of an objection in the notice of change.


13. Applicable law and place of jurisdiction

These Terms of Use and any disputes arising out of or in connection with these Terms of Use between kayvee or kessler.vogler and the user shall be governed exclusively by Swiss law. Exclusive place of jurisdiction is Zurich. However, kayvee and kessler.vogler have the right to appeal to the courts of the user's place of residence.
